

ROCKSTOCK EVENT - TERMS AND CONDITIONS OF ENTRY
LEGAL AGREEMENT
IMPORTANT NOTICE: BY PURCHASING, ACCEPTING, OR USING A TICKET TO ANY ROCKSTOCK EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OR USE A TICKET.
These Terms and Conditions of Entry ("Terms") constitute a legally binding agreement between you ("Ticket Holder," "Attendee," "You") and the event promoter, organizers, and all associated parties ("Promoter," "We," "Us," "Our") for attendance at any Rockstock event ("Event").
1. DEFINITIONS
1.1 "Event" means any Rockstock music festival, concert, or related entertainment event.
1.2 "Venue" means the location where the Event takes place, including all areas designated for Event activities.
1.3 "Ticket" means any form of admission credential, whether physical, electronic, or digital.
1.4 "Promoter Parties" includes the event promoter, organizers, venue owners, sponsors, performers, contractors, subcontractors, employees, agents, volunteers, security personnel, and any other parties involved in the production or operation of the Event.
2. TICKET PURCHASE AND VALIDITY
2.1 Tickets are non-refundable under all circumstances, except as required by law.
2.2 In the event of postponement, the Event will be rescheduled to the same weekend of the following year. No refunds will be provided for postponed events.
2.3 Tickets may only be transferred through the authorized ticketing agent (contact@railrecords.net). Unauthorized transfers may result in ticket cancellation without refund.
2.4 Each ticket admits one person only and is valid for single entry. No re-entry is permitted once the Attendee leaves the Venue.
2.5 Tickets remain the property of the Promoter until full payment is received.
3. ASSUMPTION OF RISK AND LIABILITY WAIVER
3.1 VOLUNTARY PARTICIPATION: You acknowledge that attendance at the Event is entirely voluntary and that you are participating at your own risk.
3.2 INHERENT RISKS: You understand and acknowledge that attendance at the Event involves inherent and other risks including, but not limited to:
•Risks associated with large crowds and crowd movement
•Risks from loud music and sound levels
•Risks from weather conditions
•Risks from the consumption of alcohol by yourself or others
•Risks from the actions or omissions of other attendees
•Risks from temporary structures, equipment, and facilities
•Risks associated with the coastal/outdoor location
•Risks from infectious diseases or illnesses
•Any other risks associated with live entertainment events
3.3 ASSUMPTION OF ALL RISKS: You voluntarily assume all risks of injury, illness, death, loss, or damage to person or property that may result from your attendance at the Event, whether caused by negligence or otherwise.
4. RELEASE AND INDEMNIFICATION
4.1 COMPLETE RELEASE: To the fullest extent permitted by law, you hereby release, discharge, and hold harmless the Promoter Parties from any and all claims, demands, actions, causes of action, damages, losses, costs, and expenses (including reasonable attorney fees) of any nature whatsoever, whether known or unknown, arising out of or in connection with your attendance at the Event.
4.2 INDEMNIFICATION: You agree to indemnify, defend, and hold harmless the Promoter Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or resulting from:
•Your breach of these Terms
•Your violation of any law or regulation
•Your negligent or wrongful conduct
•Any injury or damage caused by you to any person or property
4.3 NO LIABILITY: Under no circumstances shall the Promoter Parties be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, death, property damage, lost profits, or any other damages arising from your attendance at the Event.
5. CONDITIONS OF ENTRY
5.1 SECURITY SEARCHES: As a condition of entry, you consent to:
•Bag searches and inspection of all personal items
•Physical pat-down searches by security personnel
•Metal detector screening if implemented
•Any other security measures deemed necessary by the Promoter
5.2 REFUSAL OF ENTRY: The Promoter reserves the right to refuse entry or remove any person from the Event at any time without refund for any reason, including but not limited to:
•Failure to comply with these Terms
•Intoxication or impairment
•Disruptive or inappropriate behavior
•Security concerns
•Breach of venue rules
5.3 PROHIBITED ITEMS: The following items are strictly prohibited and will result in confiscation and/or removal from the Event:
•Weapons of any kind
•Illegal drugs or substances
•Outside food or beverages
•Glass containers
•Umbrellas, blankets, tents, chairs
•Prams, pushchairs, or strollers
•Oversized bags or luggage
•Professional recording equipment
•Any item deemed dangerous or inappropriate by security
5.4 PERMITTED ITEMS: Only the following items are permitted:
•Small backpacks, belt bags, hip bags
•Hand sanitizer, sunblock, sunglasses, hats
•Mobile phones, empty water bottles, lip balm, earplugs
6. MINORS AND SUPERVISION
6.1 Minors are permitted at the Event but must be accompanied by their parent at all times.
6.2 Legal guardians may only accompany minors if they provide birth certificates and valid identification proving guardianship.
6.3 Parents and guardians are solely responsible for the safety, conduct, and supervision of minors in their care.
6.4 Strollers and pushchairs are prohibited for safety reasons related to emergency egress.
7. CONDUCT AND BEHAVIOR
7.1 Attendees must conduct themselves in a lawful and appropriate manner at all times.
7.2 The following behaviors are strictly prohibited and may result in immediate removal:
•Violence, threats, or intimidation
•Harassment or discrimination
•Disorderly conduct or public disturbance
•Damage to property or equipment
•Interference with Event operations
•Any illegal activity
7.3 Attendees must comply with all instructions from Event staff, security personnel, and emergency services.
8. ALCOHOL SERVICE AND CONSUMPTION
8.1 Alcohol service is restricted to persons 18 years and older with valid identification.
8.2 The Promoter reserves the right to refuse alcohol service to any person at any time.
8.3 Attendees consuming alcohol do so at their own risk and are solely responsible for their actions while under the influence.
8.4 Outside alcohol is strictly prohibited.
9. INTELLECTUAL PROPERTY AND MEDIA
9.1 You consent to being photographed, filmed, or recorded during the Event for promotional purposes.
9.2 All intellectual property rights in Event materials belong to the Promoter.
9.3 Commercial photography or recording is prohibited without written consent.
10. FORCE MAJEURE
10.1 The Promoter shall not be liable for any failure to perform due to circumstances beyond reasonable control, including but not limited to:
•Weather conditions
•Natural disasters
•Government restrictions
•Labor disputes
•Technical failures
•Acts of terrorism or civil unrest
10.2 In such circumstances, the Event may be postponed, modified, or cancelled without liability for damages.
11. MEDICAL AND EMERGENCY SITUATIONS
11.1 You acknowledge that medical facilities at the Event are limited and may not be adequate for all medical emergencies.
11.2 You are responsible for your own medical needs and any pre-existing conditions.
11.3 The Promoter Parties are not responsible for any medical treatment or costs incurred.
11.4 You consent to emergency medical treatment if you become unconscious or unable to consent.
12. PRIVACY AND DATA PROTECTION
12.1 Personal information collected will be used in accordance with applicable privacy laws.
12.2 Information may be shared with security, law enforcement, or emergency services as necessary.
13. SEVERABILITY AND ENFORCEABILITY
13.1 If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13.2 These Terms shall be construed to provide the maximum protection permitted by law.
14. GOVERNING LAW AND JURISDICTION
14.1 These Terms are governed by New Zealand law.
14.2 Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts.
15. ENTIRE AGREEMENT
15.1 These Terms constitute the entire agreement between the parties and supersede all prior agreements or understandings.
15.2 No modification of these Terms is valid unless in writing and signed by the Promoter.
16. ACKNOWLEDGMENT AND ACCEPTANCE
BY PURCHASING, ACCEPTING, OR USING A TICKET, YOU ACKNOWLEDGE THAT:
•You have read and understood these Terms in their entirety
•You voluntarily agree to be bound by all provisions
•You understand the risks involved in attending the Event
•You waive any right to claim damages from the Promoter Parties
•You accept full responsibility for your attendance and conduct
•This agreement is legally binding and enforceable
